Purchase Terms and Conditions

General Terms

1. Gemex trading SIA, Reg. No. 40103661189, Riga, Aleksandra Čaka Street 81, LV-1011, Latvia, sells products displayed on https://www.anete.lv/. The buyer purchases and accepts products according to the order placed in the online store. Ownership of the product passes to the buyer when the product has been received and paid for in full.
2. If the order is placed in the online store, a distance contract is concluded between Anete.lv and the buyer. The rights and obligations arising from the distance contract apply to a buyer who is considered a consumer under applicable law.
3. By registering in the online store and agreeing to these terms, the buyer confirms that they are an adult legally capable person or have parental or guardian consent. A legal entity is represented by a duly authorised person.
4. In case of any breach of these terms or applicable laws, Anete.lv has the right to withdraw from the purchase agreement and/or deny the buyer access to the online store.

Prices and Payment Procedure

1. All product prices in the online store are shown including value added tax at the rate of 21%.
2. By confirming the order, the buyer agrees to pay the product price indicated at the time of placing the order.
3. If a product is offered at a promotional price, the offer is valid during the period when the order can be placed at such price.
4. In addition to the product price, the buyer pays delivery costs if a fee applies to the chosen delivery method.
5. The buyer must cover delivery costs also if the order is not delivered due to the buyer’s fault.

Payment Methods

• In cash or by payment card at the Anete.lv office.
• By prepayment via bank transfer to the account specified in the invoice.
• By payment card or by authorising payment through online banking.
• Using ESTO leasing.

Ordering and Delivery

1. To place an order, the buyer fills in the order form in the online store and confirms it. Order confirmation includes the buyer’s obligation to make payment.
2. After receiving the order, Anete.lv sends confirmation that the order has entered into force and will be fulfilled.
3. If the order concerns a product regulated by law, Anete.lv has the right to refuse the order.
4. The order is delivered using the method selected by the buyer after payment for the order and delivery costs.
5. Anete.lv delivers the product within the term indicated in the order, but no later than the maximum delivery term set by law, unless the customer has agreed to a longer delivery term.

Order Receipt Methods

• By an authorised Anete.lv courier to the buyer’s address in the Republic of Latvia at a mutually agreed time.
• To a parcel machine, parcel locker or product pick-up point.
• At the Anete.lv office, if such collection option is available for the specific order.

Buyer’s Obligations During Delivery

• Be reachable via the phone number and/or email address provided in the order.
• Agree with the delivery provider on delivery details if required for order fulfilment.
• Check the packaging and product upon receipt, if the delivery method allows it.

Order Cancellation and Refusal of Fulfilment

Anete.lv has the right to unilaterally withdraw from order fulfilment in the following cases:

• The buyer has not received the product within the specified term.
• Delivery has not been completed due to the buyer’s fault or circumstances depending on the buyer.
• It has not been possible to agree with the buyer on the delivery time and place.
• The buyer does not arrive at the agreed delivery time and/or place.
• It is not possible to identify the buyer.
• A technical error has been detected in product entry or display.

Product Use and Quality

1. Before using the product, the buyer must read the product instructions and use the product only according to the manufacturer’s instructions.
2. Anete.lv provides the buyer with all technical and quality documentation available to Anete.lv together with the product.
3. Anete.lv ensures product compliance with the manufacturer’s warranties and standards. Product images in the online store are informative and may differ from the actual product.
4. The product warranty period is determined by the manufacturer. The warranty period does not affect the consumer’s statutory rights.
5. The buyer has the right to submit a claim regarding a defect in the purchased product by contacting Anete.lv.
6. After receiving the claim, the product may be sent for diagnostics to a manufacturer-certified service centre.
7. Anete.lv obligations do not apply to defects caused by improper use, transport, storage or normal wear and tear.

Right of Withdrawal and Product Returns

1. A buyer who is considered a consumer under applicable law has the right to exercise the right of withdrawal within 14 days from delivery of the product.
2. The right of withdrawal does not apply to purchases that are not concluded remotely.
3. When exercising the right of withdrawal, the buyer must return the product to Anete.lv and cover the costs related to returning the product.
4. The procedure for exercising the right of withdrawal and the withdrawal form are available in the Product Returns section.
5. For hygiene and health reasons, the 14-day right of withdrawal does not apply to hygiene products if the product packaging has been opened.
6. If Anete.lv determines that the buyer has exercised the 14-day right of withdrawal three times within one month, Anete.lv reserves the right to refuse a new order placed using means of distance communication.
7. A discount code granted to the buyer is intended for one-time use. If the product is returned, a new discount code is not issued.

Dispute Resolution and Communication

The buyer may submit an objection regarding the purchase transaction electronically by sending it to info@anete.lv.

Anete.lv provides a reply to the buyer’s objection no later than within 30 days. Disputes regarding fulfilment of obligations are resolved through negotiation.

Personal Data Processing

1. The buyer is informed that personal data is processed when using the online store services.
2. Data is processed for concluding and fulfilling the order, including solvency checks, delivery provision and payment processing.
3. The buyer’s data may also be processed to ensure Anete.lv legitimate interests, including maintaining a customer database, statistics, customer information and credit risk management.
4. Information about the buyer’s creditworthiness from out-of-court debt recovery databases is obtained only with the buyer’s consent.
5. Anete.lv has the right to transfer to third parties debt collection rights arising from the purchase and the buyer’s data necessary for collection.

Changes to the Terms

Anete.lv has the right to amend these terms at any time by publishing the changes on the website. The buyer must review the terms before using the online store, registering or placing an order.

Use of the online store, registration or placing an order after publication of changes to the terms is considered the buyer’s consent to these changes.
