Terms and conditions

When visiting https://www.anete.lv/ and/or making purchases from https://www.anete.lv/, please read and accept this set of Terms and Conditions of Purchase (the "Terms"):

General rules

1. Gemex trading SIA, Reg. No. 40103661189, Riga, Aleksandra Čaka iela 81, LV-1011, Latvia (hereinafter - Anete.lv) sells goods placed on the website https://www.anete.lv/ (hereinafter - e-shop) and the Buyer buys and accepts the goods according to the range of goods specified in the order placed on the e-shop (hereinafter - the order). Title to the Goods shall pass to the Buyer on the date on which both of the following conditions have been met: the Goods have been received and payment for them has been made in full.

  • If the purchase contract (order) is concluded in the e-shop, a distance contract is concluded between Anete.lv and the buyer. The rights and obligations arising from the distance contract shall apply to the buyer who is recognised as a consumer (a natural person who purchases goods for a purpose not related to his/her economic or professional activity) in accordance with the laws and regulations.

2. By registering on the e-shop and agreeing to these Terms, the Buyer confirms that he/she is of legal age or has the consent of a parent or guardian (if the Buyer is a minor between the ages of fourteen and eighteen). If the purchaser is a legal person, a duly authorised person shall act on its behalf. The Buyer confirms that he/she will use the e-shop in compliance with the requirements of the laws and regulations. In the event of any breach of the Terms and Conditions or laws and regulations, Anete.lv shall have the right to immediately withdraw from the contract for the purchase of goods and/or to prevent the Buyer from using the e-shop.

 

Price and payment

3. All prices in the e-shop are inclusive of value added tax (21%), which is set by the laws and regulations. By confirming the order in accordance with the order form, the Customer agrees to pay the price of the goods as indicated at the time of ordering.

4. If the product is offered at a special offer price (promotional price), the offer is valid for the period during which the order can be placed at that price.

5. In addition to the price of the goods, the buyer shall pay the delivery costs of the goods if a charge applies for the particular type of delivery. By confirming an order, the Buyer agrees to the amount and payment of the delivery charges specified therein. The Buyer is also obliged to pay the full delivery costs if the order is not delivered (handed over) to the Buyer due to the Buyer's fault (including failure to be at the agreed place/time), as well as the costs of redelivery if agreed by the parties.

6. You can pay for your order and delivery costs in the following ways:

6.1. in cash or by payment card at the Anete.lv office;
6.2. by prepayment by bank transfer to the current account indicated on the invoice;
6.3. by card or online banking;

6.4. ESTO leasing

7. Settlement can be made in a single instalment or under hire purchase terms by agreement.

8.The terms of payment depend on whether the buyer is a natural or legal person.

9. Payment of the order is evidenced by a proof of payment (certified payment order, cashier's cheque, cash receipt). If the Buyer pays by bank transfer, the date of payment shall be the day on which the payment is received in Anete.lv's current account.

 

Ordering and delivery

10. To place an order, the Buyer who has accepted these Terms and Conditions shall complete the order form on the e-shop's website and accept it by clicking on the button marked as such. The acceptance of the order implies the obligation of the buyer to pay. Anete.lv shall, upon receipt of the Buyer's order, send a confirmation of the validity and execution of the order. The order is valid until it is fulfilled or until either party withdraws from it in the cases provided for in these Terms and Conditions.

10.1. In the event that the order is made for a product regulated by law, Anete.lv, after evaluating the legal aspect of the order, has the right to refuse the order.

11. Delivery of the order shall be made in the manner chosen by the Buyer, after payment of the order and delivery costs (if any). Anete.lv shall deliver the goods within the period specified in the order, but not longer than the maximum delivery period specified by law, unless the customer has consented to a longer delivery period.

12. The following options are available:

12.1. By Anete.lv authorised courier at a mutually agreed time to the address specified by the buyer in the Republic of Latvia, within 1-2 working days from Anete.lv notification that the order is ready for delivery;
12.2. For delivery to a parcel/packing cabinet or a delivery point, within 1-3 working days after receipt of Anete.lv's notification that the order is ready for delivery;

13. The Buyer is obliged to be reachable at the telephone number and/or e-mail address indicated in the order in order to agree with the order supplier (courier) on the delivery details (time, place) and other matters for the execution of the order.

14.The order shall be deemed to have been fulfilled if the goods have been handed over to the Buyer at a time and place agreed with the Buyer, the identity of the person has been verified by means of an identity document (passport, ID card), and an acceptance and handover certificate has been signed by both parties. If the goods are delivered by courier, Anete.lv has authorised the courier to sign the acceptance - handover act on behalf of Anete.lv.

15. If the goods are delivered via a parcel/packing cabinet, the order shall be deemed to have been fulfilled when the buyer has removed the goods from the parcel/packing cabinet via the delivery notification received by text message and/or e-mail with the parcel/packing cabinet door opening code.

16. If the Buyer has ordered several goods in one order, which shall be delivered separately, or if the Buyer is delivered goods consisting of several lots or parts, the order shall be deemed to be fulfilled on the day on which the Buyer has received the last of the goods in accordance with the method of delivery chosen.

17. Unless the parties agree otherwise, Anete.lv unilaterally has the right to withdraw from the execution of the order in the following cases:

17.1. the Buyer has not received the Goods within the time specified in these Conditions or delivery has not been made due to the Buyer's fault or circumstances beyond the Buyer's control;
17.2. You fail to agree with the buyer on the time and place of delivery within the time limit set by the rules;
17.3. the buyer fails to arrive at the agreed time and/or place of delivery,
17.4. the buyer cannot be identified

17.5. a technical deficiency in the entry/display of an item has been detected, without the reason being explained.

18. The goods are delivered in the manufacturer's packaging. If the Goods are received at Anete.lv's office, the Goods or their packaging shall be inspected for any defects in the presence of both parties.

 

Use and quality of the product

19. Before using the goods, the buyer is obliged to read the instructions for use carefully and to use the goods only in accordance with the manufacturer's instructions, in accordance with the characteristics of the goods and for the intended purposes. Anete.lv shall provide the Buyer with all technical and quality documentation of the product that Anete.lv has.

20. Anete.lv guarantees that the goods sold comply with the manufacturer's warranties and standards. The visual representation of the product in the e-shop is for information only and may vary in nature.

21. The warranty period is set by the manufacturer. The warranty period shall not affect the rights provided for in the laws and regulations.

22. The Buyer has the right to submit a claim for a defect in the purchased goods by contacting Anete.lv. Upon receipt of the application, the product is sent for diagnostic examination to a service centre certified by the manufacturer. Anete.lv shall take a decision on the submitted claim after receiving the conclusion of the manufacturer's certified service centre.

23. Claims regarding the conformity of the goods with the terms of the contract shall be considered by Anete.lv in accordance with the procedure established by the Consumer Rights Protection Law. If the buyer is not recognized as a consumer, the customer's application for non-conformity of the goods shall be examined in accordance with the concluded contract and the answer shall be provided to the buyer within 30 (thirty) days.

24. Anete.lv's obligations shall not apply to defects resulting from improper use, transport and/or storage of the goods, as well as to normal wear and tear of the goods in the course of their operation.

25. During and after the warranty period, the Goods shall be serviced in accordance with the warranty provided by the manufacturers of the Goods and these Conditions at the service centres authorised by the manufacturer of the Goods and specified in the documentation accompanying the Goods. The warranty and after-sales service terms of the Product can be found at https://anete.lv/ under "Warranty".

 

Obligations of the Parties and other provisions

26. The Buyer may submit an objection to the purchase transaction electronically by sending an e-mail to info@anete.lv. Anete.lv shall reply to the Buyer's objection by e-mail no later than within 30 (days). Disputes concerning the performance of obligations shall be settled by negotiation.

27. The Buyer, who is considered a consumer (natural person) under the laws and regulations, has the right to exercise the right of withdrawal within 14 days of delivery of the goods. The moment of delivery of the goods shall correspond to the moment of order fulfilment set out in the Terms and Conditions and shall depend on the chosen method of receipt of the goods. The right of withdrawal shall not apply to purchases not concluded at a distance.

28. In case of exercising the right of withdrawal, the buyer is obliged to return the goods purchased in the Anete.lv e-shop, bearing the costs related to the return of the goods. The procedure for exercising the right of withdrawal and the withdrawal form can be found here.

29. In accordance with the procedure set out in Paragraph 22.5 of the Cabinet of Ministers Regulation No 255 of 20 May 2014 "Regulations on Distance Contracts", for reasons of hygiene and health, the 14-day right of withdrawal does not apply to hygiene products if the packaging of the product has been opened.

30. If Anete.lv determines that the Buyer has exercised the 14-day right of withdrawal provided for in the laws and regulations three times within one month, Anete.lv reserves the right to refuse the Buyer to place a new order by means of distance communication.

31. The discount code granted to the Buyer is for a one-time purchase in the Anete.lv e-shop, and if the purchased item is returned to the Seller for any reason, a new discount code will not be granted.

32. The Buyer is aware that the use of the e-shop services involves the processing of the Buyer's personal data. The processing of the Buyer's personal data is carried out for the purposes of the conclusion and performance of the order (contract): for checking the Buyer's solvency, for ensuring the delivery of the Goods, for payment processing.

33. The Buyer's data is also processed for the purposes of Anete.lv's legitimate interests, including the creation of a database of buyers, statistics, informing buyers about E-store news, improving goods and services, customer care communication, credit risk management, etc.

34. Information on the creditworthiness of the Buyer is obtained from databases of out-of-court debt recovery services only with the consent of the Buyer.

35. The Buyer is informed that Anete.lv has the right to transfer to third parties the debt arising from the purchase, the right of recovery and the Buyer's data necessary for collection.

36. The data controller of the data processing carried out by the online shop is the Limited Liability Company "Gemex trading", Reg. No. 40103661189, Riga, Aleksandra Čaka iela 81, LV-1011, Latvia. Information on the processing of data of natural persons by Anete.lv can be obtained by contacting Anete.lv at info@anete.lv, as well as Anete.lv Privacy Policy, which can be found at Privacy Policy .

37. Anete.lv uses the e-mail address and/or telephone number provided by the buyer when registering in the E-shop to contact the buyer. All notifications delivered to the e-mail address and telephone number provided in the order shall be deemed to have been received.

38. By visiting, registering and/or ordering from the E-Shop, the Buyer agrees to these Terms and Conditions, including those referenced herein in the form of links. Any new services and functionalities of the Online Shop are subject to these Terms. Anete.lv has the right to amend these Terms at any time by posting them on this website and it is the Buyer's responsibility to review the Terms before using, registering and/or ordering from the Online Shop. Use of the Online Shop, registration and/or placing an order after any changes to the Terms have been posted shall constitute the Buyer's acceptance of such changes.
